WARRANTY & RETURNS

Ghost Herbal Concepts Ltd, trading in the USA as Ghost Vapes Inc, (“GHOST”) is a manufacturer of innovative high-quality vaporizers and offers the following warranty.

GHOST provides a limited warranty to the original purchaser (“Customer”) on the GHOST MV1 Vaporizer (“Device”), against defects in materials and/or workmanship for a period of 2 years from the date of purchase, a period which will be extended to 5 years from the date of purchase upon registration of the Device with GHOST via the GHOST smartphone App (“The App”) or via the My Account section of the website within 90 days of the date of purchase.   

The following warranty does not cover the battery contained in the device.  GHOST warrants the original battery that ships with the Device against defects in materials and/or workmanship for a period of 1 year from the date of purchase.  Ghost further warrants the MV1 Spare Battery Pack (sold separately) against defects in materials and/or workmanship for a period of 1 year from the date of purchase.

If a warranty claim is accepted within the time period shown above, GHOST may choose to either 1) repair or correct any defect found covered by this warranty or 2) replace the defective Device or parts with a new Device or parts.

GHOST may supply parts and assemblies in any repair or correction that deviates from the original parts and assemblies supplied with the Device and/or use new technology and or materials that have been developed by GHOST subsequent to the original purchase of the Device.

This warranty applies solely to the Customer and is not transferable to subsequent owners, including if the Device is resold or gifted second-hand in any way, nor will any warranty apply to any Device purchased second-hand or through unauthorised resellers. Please contact GHOST if you would like information regarding our authorised dealer network.

For the avoidance of doubt the term “authorised resellers” applies solely to retailers and distributors officially authorised by GHOST to stock and sell our products. GHOST products are not sold via marketplace websites, including but not limited to Amazon, eBay and Alibaba, and GHOST will not provide warranty coverage for any Devices sold via these unauthorized resellers or any similar channels.

Immediately upon delivery, Customer shall examine and inspect the Device for any visible defects prior to fully charging and using the Device for the first time. In the event that the Customer discovers any defects or faults with the Device, the Customer must immediately notify GHOST using the contact form on the website, carefully outlining any defects or missing parts.

This warranty is only valid and applicable in the countries in which GHOST sells in and ships to.

This warranty is subject to normal storage, handling and use of the Device itself in line with the Product Manual, Quick Start Guide and other company literature that may be produced from time to time and does not apply to any GHOST accessories supplied either with the Device (cleaning accessories, merchandise, clothing, screens and pads etc.) or purchased subsequently at a later date.


LIMITATIONS AND EXCLUSIONS

GHOST HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, ANY IMPLIED WARRANTIES WITH RESPECT TO THE PRODUCTS AND SERVICES LISTED OR PURCHASED FROM GHOST, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND SECURITY. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, GHOST HEREBY EXPRESSLY DISCLAIMS ALL LIABILITY FOR PRODUCT DEFECT OR FAILURE, CLAIMS THAT ARE DUE TO NORMAL WEAR, PRODUCT MISUSE, ABUSE, PRODUCT MODIFICATION, IMPROPER PRODUCT SELECTION, NON-COMPLIANCE WITH ANY CODES, INTELLECTUAL PROPERTY INFRINGEMENT OR MISAPPROPRIATION. GHOST MAKES NO WARRANTIES TO THOSE DEFINED AS “CONSUMERS” IN THE MAGNUSON-MOSS WARRANTY ACT.

Any claim under either the standard warranty or extended 5-year warranty must be accompanied by the original proof of purchase for the Device showing place, date and time of purchase through an authorised reseller.

For use by adults only. This device is not designed or sold for use with tobacco, or any tobacco product, or as a tobacco substitute.  This device does not allow for the use of e-liquids, nicotine replacement products, or aromatherapy oils.  Any attempt to use this device with e-liquids could result in damage to the device itself, and is accordingly not covered by this warranty or any other warranties--express or implied.  This device is sold strictly for use with legal substances only.

This warranty does not cover:

  • Damage caused by the Customer to the glass stem.
  • Everyday wear and tear due to normal usage, including but not limited to deterioration in finish or appearance or accidental damage caused by dropping or other careless handling of the Device.
  • Damage caused by any apparent attempt to either open or disassemble the main body of the Device or carry out unauthorised repairs.
  • Damage caused by failure to properly observe the safety and operating instructions contained within the Product Manual.
  • Failure of the heat element through misuse.
  • Damage caused by misuse and or neglect - including failure to maintain and clean the Device regularly, or operation of the Device outside of the conditions provided in the Product Manual including the use of e-liquids, or apparatus or accessories that have not been manufactured, sourced or approved by GHOST.
  • Damage caused by natural disasters, acts of God and other forms of force majeure.
  • Damage caused by exposure to moisture, liquids, rain, salt water, extreme humidity, extreme thermal exposure, dirt, sand and other extraneous environmental conditions


RETURNS

14-Day Return Policy

GHOST will accept returns of products sold via it’s website within 14 days of purchase without the Customer needing to demonstrate a defect of the products purchased. The Device must be unused and remain in the original packaging with the security seal unbroken. The Customer is liable for any return expense and is advised to use a tracked delivery service to ensure the product or products to be returned are delivered successfully. GHOST is not responsible for any product lost or stolen during any return process. GHOST will refund the full purchase price within 14 days of receipt of returned goods once it has been verified they are in their original condition and packaging.

Should you purchase your Device or other GHOST branded products from an authorised reseller, your return will be governed by the return policy of such authorised reseller.  You may not return a Device purchased from an authorised reseller directly to GHOST.

Warranty Return Policy

In the event that Customer suspects a default with a Device, Customer should contact GHOST by one of the following means:

In order to assess the reported problem, GHOST may request additional details from the Customer, including photos and/or videos to determine whether warranty service is required.

Following receipt and investigation of the apparent defect, if GHOST’s service agents deem a return necessary then a Return Merchandise Authorization (RMA) number will be provided and a shipping label generated which can be printed by the Customer.

The product for return should be thoroughly cleaned, placed into its original box if possible, or a suitable size bubble wrap protective envelope, or similar suitable packaging material, with the shipping label affixed in the standard place.

GHOST and or its authorised service agents will use their commercially reasonable efforts to, within a period of no more than 5 working days from receipt of the return package, establish whether the returned product can be repaired or whether it is necessary to supply a replacement product. If a repair is to be carried out, the Customer will be advised as to the expected time when the repair will be complete and the product returned. If a replacement is to be supplied then the replacement will be sent out at GHOST’s expense, via a standard delivery service with the Customer advised of the tracking details.

If GHOST deems that the best course of action is a replacement and the Device in question is a limited edition or a variation of the product that is no longer available, then GHOST will replace the Device with a current version available at the time.

If requested GHOST will ship replacement parts or Devices on an expedited rush basis with the Customer responsible for any additional shipping and handling charges.

The RMA will at all times be the reference number to be quoted with regard to the return or repair.

In the event that a Device is incorrectly returned to GHOST under warranty and no defects are discovered, the Customer will be liable for any costs associated with the examination and return of the Device at the sole discretion of GHOST


LIMITATION OF LIABILITY

IN NO EVENT WILL GHOST VAPES, OR ANY OF ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AFFILIATES, AGENTS, SUCCESSORS OR ASSIGNS BE LIABLE TO YOU OR ANYONE ELSE FOR (A) ANY DIRECT DAMAGES IN EXCESS OF THE AMOUNT PAID FOR THE DEVICE; OR (B) ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE DEVICE, THE USE OR INABILITY TO USE THE DEVICE, OR THE MATERIALS, INFORMATION OR SERVICES PROVIDED IN CONJUNCTION WITH THE DEVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN THE EVENT OF ANY PROBLEM WITH THE DEVICE OR ANY OTHER PRODUCTS THAT YOU HAVE PURCHASED FROM GHOST, YOU AGREE THAT YOUR SOLE REMEDY IS TO SEEK A RETURN OR REPLACEMENT IN ACCORDANCE WITH THIS POLICY.

CERTAIN STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS AND/OR DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. YOU MAY ALSO HAVE OTHER RIGHTS WHICH MAY VARY DEPENDING ON YOUR SPECIFIC GEOGRAPHICAL LOCATION.


LEGAL NOTICE TO NEW JERSEY RESIDENTS

No provision in this Warranty and Returns Policy shall apply to any consumer in New Jersey if the provision limits redress for/under: (i) GHOST tortious actions (e.g., negligence, failure to exercise a basic standard of care, failure to avoid creating an unreasonable risk of harm); (ii) the New Jersey Products Liability Act, N.J.S.A. 2A:58C-1, et seq. (i.e., the statutorily imposed duty to refrain from manufacturing and selling dangerous products, with the possibility of punitive damages for violations thereof); (iii) the New Jersey Punitive Damages Act, N.J.S.A. 2A:15-5.9, et seq. (i.e., the statutory right to pursue punitive damages in the event of harm caused by actual malice, wanton and willful disregard, reckless indifference); (iv) the New Jersey Uniform Commercial Code (i.e., a comprehensive statutory regime governing the rights and duties of buyers and sellers with respect to contracts for the sale of goods, with the possibility of damages for economic and property harm); and (v) GHOST’s failure to reasonably protect against harm arising from certain criminal acts of third parties (e.g., computer hacking and identity theft, as regulated by the Federal Trade Commission and the Federal Communications Commission, and as governed by the New Jersey Identity Theft Protection Act, N.J.S.A.56:8-161, et seq., and the New Jersey Consumer Fraud Act, N.J.S.A. 56:8-3, et seq.). With respect to this Policy, the provision concerning the exclusion or limitation of certain damages is not applicable in New Jersey with respect to statutory damages, punitive damages, loss of data, and loss of or damage to property.
